Who can report a concern
A whistleblower is considered to be an individual who communicates or publicly discloses an offence based on information obtained in the course of their professional activity, regardless of the nature of that activity or the industry in which they operate. Legal protection also applies to anyone who, acting in good faith, reports or publicly discloses offences based on information that, at the time of communication, they believe to be true, even if that information was obtained during a recruitment process, in pre- contractual negotiations or in the context of a professional relationship that has already ended.
Conditions for protecting whistleblowers
The conditions for the protection of whistleblowers applied by Edinorte fully comply with the provisions of Article 6 of Law No. 93/2021. This legislation establishes that protection is always centred on the fact that the complaint is made in good faith and based on serious grounds. According to the law, internal whistleblowing channels must allow reports to be submitted and monitored securely, ensuring their completeness, integrity and preservation, as well as the confidentiality of the whistleblower's identity — or their anonymity — and also the confidentiality of the identity of any third parties mentioned in the report. It is also mandatory to ensure that these channels are managed with complete independence, impartiality, confidentiality, respect for personal data protection, secrecy and absence of conflicts of interest, in order to guarantee the credibility, effectiveness and trustworthiness of this essential mechanism for preventing and detecting irregularities.
Report an irregularity or inquire about a complaint
According to Law No. 93/2021, of 20 December (“Law”), which transposed Directive (EU) 2019/1937 of 23 October 2019 on the protection of persons who report wrongdoing into Portuguese law.
In case of an inquiry about a complaint, please enter the Tolken number you received when you submitted the complaint.
